Asked 11/10/2009

Can I use my HSA to pay medical bills from last year when I had no HSA?

Last year I did not have an HSA account and I incurred medical bills which I am still paying on. In January when I have my HSA, can I use that to pay for the medical bills from this past year?

No. Expenses incurred before the creation of the HSA are not considered "qualifying medical expenses" for HSA tax purposes.

If you had an Archer MSA or another HSA that you rolled into this one, then your "creation date" would be the creation of the prior account.

Unfortunately, no. You cannot use the HSA funds to pay for expenses incurred prior to be eligible for the HSA. However, after you have funds in the account, you can use them to pay for medical expenses even if you are no longer eligible to contribute.

For example, if you have an HSA in 2010 but then are not in a HDHP in 2011, you can still use the funds that you contributed in 2010 for 2011 expenses.
